Правила использования материалов газеты «Ведомости»
1. Общие положения
1.1.
Любое использование материалов газеты «Ведомости» допускается только с разрешения ее издателя и правообладателя — ЗАО «Бизнес Ньюс Медиа». Данные Правила определяют условия и порядок использования материалов газеты «Ведомости» (материалы, размещенные в печатной версии газеты, и материалы, размещенные на сайте www.vedomosti.ru) с разрешения ЗАО «Бизнес Ньюс Медиа».
Под использованием понимается любое воспроизведение, распространение, доведение произведения до всеобщего сведения, перевод и другая переработка произведения и другие способы использования, предусмотренные Гражданским кодексом Российской Федерации.
1.2.
Использование материалов газеты «Ведомости» с нарушением любого из условий данных Правил означает, что произведение используется без разрешения ЗАО «Бизнес Ньюс Медиа», что является нарушением исключительных прав ЗАО «Бизнес Ньюс Медиа» и может повлечь ответственность, предусмотренную действующим законодательством РФ.
1.3.
Действие настоящих Правил распространяется на информационные агентства, пользователей электронной и печатной версии газеты «Ведомости», официальные интернет-узлы компаний, тематические интернет-узлы и интернет-СМИ, еженедельники, ежемесячники и прочие печатные издания, газеты, журналы, физических лиц и других пользователей (далее Пользователи).
2. Бесплатное использование
2.1.
Любой Пользователь вправе свободно:
- составлять дайджест любого количества материалов газеты «Ведомости» в обзорах СМИ в виде кратких аннотаций материалов, в объеме, оправданном целью создания дайджеста (обзора прессы). Подобное использование исключает возможность использование статьи газеты «Ведомости» в полном объеме;
- бесплатно цитировать любое количество материалов газеты «Ведомости» в объеме, оправданном целью цитирования. Подобное цитирование должно содержать в себе ссылку на источник в порядке, установленном п. 5.1.1 настоящих Правил.
2.2.
ЗАО «Бизнес Ньюс Медиа» предоставляет право бесплатного воспроизведения и распространения материалов газеты «Ведомости» нижеобозначенным Пользователям с соблюдением п. 5 настоящих Правил на следующих условиях и в объемах:
физические и юридические лица, упомянутые в произведениях газеты «Ведомости», вправе бесплатно перепечатывать, сообщать в эфир или по кабелю, доводить до всеобщего сведения статьи и иные материалы, содержащие такие упоминания.
3. Коммерческое использование
3.1.
Для использования материалов газеты «Ведомости» способами и объемами, не подпадающими под условия, указанные в пункте 2, Пользователям следует заключить договор с ЗАО «Бизнес Ньюс Медиа». Расценки на коммерческое использование приведены в п. 3.3.
3.2.

3.3.
4. Ограничение бесплатного использования
Настоящими Правилами запрещается без оплаты прав на использование:
4.1.
Передача и воспроизведение текстов статей или их фрагментов иными способами и в иных случаях, кроме указанных в пункте 2 настоящих Правил. В том числе, в e-mail, RRS или sms-рассылках, форумах, на интернет-сайтах, корпоративных и других непубличных узлах.
4.2.
Создание интерактивных баз данных.
4.3.
Любое коммерческое использование материалов, в том числе воспроизведение текстов статей или их фрагментов с целью коммерческой реализации права доступа к указанным материалам или передачи прав на такое использование третьим лицам.
4.4.
Использование материалов и статей газеты «Ведомости» способами и объемами, прямо не разрешенными данными Правилами, а также с несоблюдением требований п.5 настоящих Правил.
5. Обязанности каждого Пользователя при публикации материалов
При публикации материалов газеты «Ведомости» каждый Пользователь обязан соблюдать следующие правила:
5.1.
Оформлять ссылки на источник материалов.
5.1.1.
При цитировании материалов газеты «Ведомости» в печатном виде допускается указывать только наименование «Ведомости». При цитировании материалов газеты «Ведомости» в сети Интернет ссылка на источник должна содержать указание на газету «Ведомости» и являться гиперссылкой на сайт www.vedomosti.ru.
5.1.2.
При воспроизведении в дайджесте прессы фрагмента статьи Пользователь обязан указать имя автора, источник и дату ее опубликования.
5.1.3.
При воспроизведении материалов газеты в печатном издании, радио-, теле-, видео- программе Пользователь обязан указать имя автора статьи, источник и дату её опубликования.
5.1.4.
При воспроизведении в интернете Пользователь обязан помимо соблюдения требований пп. 5.1.1–5.1.3 дать гиперссылку на сервер http://vedomosti.ru. Эта гиперссылка должна располагаться в начале, в тексте или сразу после воспроизводимого материала.
5.2.
Соблюдать точность воспроизведения.
5.2.1.
При любом воспроизведении материалов не допускается переработка их оригинального текста. Сокращение или перекомпоновка частей материала допускается, но только в той мере, в какой это не приводит к искажению его смысла.
5.2.2.
Ответственность за искажение смысла материалов, возникшее вследствие их неточного воспроизведения, лежит на Пользователе.
6. Настоящие Правила не являются договором
ЗАО «Бизнес Ньюс Медиа», издатель газеты «Ведомости», может в любое время изменить любой пункт настоящих Правил без уведомления Пользователей.

Terms and conditions of using materials from the Vedomosti daily
1. General provisions
1.1.
Any use of materials from the Vedomosti daily is allowed only with authorization from its publisher and copyright holder, ZAO «Business News Media». The present Terms and Conditions set out the procedure of using materials from the Vedomosti daily (materials published in the printed version of the daily and materials published on the www.vedomosti.ru
web-site) with authorization from ZAO «Business News Media».
«Using» is understood to mean any reproduction, distribution, publication, translation or other modification of content, as well as other actions specified by the Civil Code of the Russian Federation.
1.2.
The use of materials from the Vedomosti daily in violation of any provision of the present Terms and Conditions means that content is being used without authorization from ZAO «Business News Media» and, therefore, constitutes an infringement of ZAO «Business News Media»’s exclusive rights and may entail liability established by the active legislation of the Russian Federation.
1.3.
The present Terms and Conditions apply to news agencies, users of electronic or printed version of the Vedomosti daily, official Internet websites of the companies, thematic Internet websites and Internet media, weekly, monthly and other printed publications, newspapers, magazines, natural persons and other users (hereinafter referred to as Users).
2. Free use of materials
2.1.
Any User has a right for a free:
- digest compiled from any number of materials from the Vedomosti daily and completed as short summaries of the materials for mass media reviews in the amount that is valid for a digest (press review). Such use of the materials eliminates a possibility of using the whole article from the Vedomosti daily;
- quotation of any number of materials from the Vedomosti daily and in the amount that is valid for quoting. Detailed quotes should include a reference to the source in the order stipulated in article 5.1.1 of the present terms and conditions.
2.2.
ZAO «Business News Media» accords a right to free reproduction and distribution of materials from the Vedomosti daily to the following Users if they abide article 5 of the present terms and conditions and on the following terms and in these amounts: natural persons and legal entities mentioned in the materials of the Vedomosti daily are entitled to free reprinting, broadcasting and reproducing via cable of the articles and any other materials that contain such mentioning.
3. Commercial use of materials
3.1.
For the use of materials from the Vedomosti daily in the ways and amounts that do not come within the terms stipulated in article 2 the Users are to enter into an agreement with ZAO «Business News Media». The prices for commercial use of materials are listed in article 3.3.

Price of commercial use of Vedomosti daily materials

3.3.
4. Limitations to free use of materials
Under the present terms and conditions if the rights to use the materials have not been purchased it is prohibited to:
4.1.
Broadcast and reproduce texts of the articles or parts of the articles in any ways or in any situations except for those stipulated in article 2 of the present terms and conditions including via e-mail, RRS or sms postings, forums, Internet websites, corporate and other non-public websites.
4.2.
Create interactive data bases.
4.3.
Use materials for any commercial purposes including reproduction of the texts from the articles or their parts in order to enforce the access to the mentioned materials with commercial purposes or delegate these rights for commercial use to the third parties.
4.4.
Use the materials and articles from the Vedomosti daily in ways and in amounts not allowed specifically in the present terms and conditions and also that do not comply with requirements stipulated in article 5 of the present terms and conditions.
5. Obligations of every user when publishing materials
Every User must abide the following rules when publishing materials from the Vedomosti daily:
5.1.
Make references to the source of the materials.
5.1.1.
When the materials from the Vedomosti daily are quoted in the printed versions it is allowed to indicate just «Vedomosti» as a reference. When the materials from the Vedomosti daily are quoted in the Internet the reference to the source must contain the indication to the Vedomosti daily and be a hyperlink to www.vedomosti.ru website.
5.1.2.
When a part of the article is reproduced in the press digest the User must specify the author’s name, the source and the date of its publication.
5.1.3.
When materials from the daily are reproduced in the printed editions, radio, television and video programmes the User must specify the author’s name, the source and the date when this article was published.
5.1.4.
When materials from the daily are reproduced in the Internet besides adhering to the requirements of articles 5.1.1–5.1.3 the User must include a hyperlink to http://vedomosti.ru server. This hyperlink must be placed in the beginning of the material, in the text itself or immediately after the reproduced material.
5.2.
Reproduce the materials accurately.
5.2.1.
The changes to the original text are not allowed during any reproduction of the materials. Reduction of the text and rearrangement of its parts is allowed only and to the extent when it does not change the meaning of the materials.
5.2.2.
The change of the meaning caused by the inaccurate reproduction of the materials is the responsibility of the User.
6. Present terms and conditions are not an agreement
ZAO «Business News Media», publisher of the Vedomosti daily, can introduce changes to any article of the present terms and conditions at any time without notifying the Users.
